- August 29, 2011. Dan Bishop and Cabarrus
County Attorney Richard Koch appeared for Cabarrus County, moving to
dismiss a suit commenced by Charlotte Motor Speedway, LLC and
Speedway Motorsports, Inc. Cabarrus County Civil Action No.
11-CVS-1923.
- August 12, 2011. Dan Bishop and Joe Moss
appeared on behalf of Mecklenburg County, moving to dismiss a suit
commenced by the Charlotte-Mecklenburg Hospital Authority, d/b/a
Carolinas Healthcare System arising out of a joint undertaking for
the provision of Health Department and psychiatric inpatient
services at Carolinas Medical Center-Randolph. Mecklenburg
County Civil Action No. 11-CVS-13379.
- July 6, 2011. Dan Bishop defended
residential estate owners in a multi-day AAA arbitration of an
estate auction company's commission claim. The claim was
defeated and Dan's clients recovered their cost of defense.
- December 7, 2010. The North Carolina Court of Appeals reversed, in favor of Dan Bishop's client, a summary judgment order entered in July 2009 by Judge Tennille in the Business Court. Leiber v. Arboretum Joint Venture, LLC, No. COA09-1284 (N.C. App. Dec. 7, 2010). The case returns to the Business Court for trial,
now set for May 7, 2012.
- August 25, 2010. United States District Judge Terrence Boyle granted summary judgment for Dan Bishop's client — a Charlotte attorney — dismissing as without merit malpractice and other claims arising from a tax-credit financing transaction. North American Savings Bank, F.S.B. v. Melvin L. Henderson, et al., Case No. 5:08-CV-601 (E.D.N.C. Aug. 25, 2010). Update November 10, 2010: The claimants dismissed their appeal to the Fourth Circuit, rendering the dismissal permanent in favor of the firm's client.
July 2010. BCM marked ten years in our SouthPark Siskey Building offices. Having found this location to be optimal for our clients, we have renewed our lease again and expanded our space for more ample conference room facilities. We expect modifications to be complete by the end of 2010.

July 9, 2010. United States District Judge Frank Whitney entered a default judgment of approximately $900,000 for Dan Bishop's client — a Virginia executor — against a non-lawyer residential real estate settlement agent. The action began by a lender's suit against the executor to enforce a mortgage of a North Carolina beach property. The estate avoided all liability for the mortgage and settled with other parties for its out-of-pocket defense costs. Our firm has filed further suit to establish that the default judgment is within the coverage terms of a professional liability insurance policy. Chase Bank USA, N.A. v. Jun. 1, 2010. The North Carolina Court of Appeals affirmed an $825,000 wage recovery won by Dan Bishop and Joe Moss in a December 2007 jury trial in the Business Court. The collectible judgment exceeds $1 million, including interest due. Kornegay v. Aspen Asset Group, LLC, 693 S.E.2d 723 (N.C. App. 2010).
