Conflicts are a bedeviling fact of life in large law firms — particularly as firm sizes continue to grow through consolidation. We run into conflicts also, but rarely. This fact makes us a resource for our large-firm colleagues in two important respects. First, when a long-term client has a matter that presents a conflict, a lawyer can refer the case to us with confidence that it will be handled with skill but without jeopardizing the larger client relationship.
Second, in some cases, because of a large number of parties requiring separate representation, even finding a firm without a conflict can be challenging or time-consuming. Or affiliated parties in the same action may have differing interests, making separate, but coordinated, representation desirable. Our relative freedom from conflicts and broad commercial litigation experience make us a quick and convenient solution.
We are a quick, reliable and cost-effective local counsel option for out-of-state or even out-of-town lawyers. Lead counsel for one large business client engaged us on a recent Friday to appear with them as soon as possible to apply for temporary injunctive relief in federal court. We knew the scheduling practices for the presiding district court judge and were able to advise lead counsel and secure a hearing the following Monday. A defect in diversity jurisdiction was revealed at the hearing, resulting in immediate dismissal. We contacted the chief resident state superior court judge immediately and arranged another hearing the same day. The injunction was entered.
We accept select contingent fee engagements, usually involving large and complex claims that we evaluate to have a high likelihood of litigation and collection success. We have won recoveries for clients under such arrangements in a variety of types of disputes, including insurance coverage, business dissolution ("Meiselman"), wage payment, independent commissioned representative and securities brokerage cases.
