General
Commercial Litigation.
The bread and butter of our
litigation practice consists of general commercial litigation on behalf of
our corporate clients. Our
practice ranges from simple breach of contract actions to complex trade
secret litigation. By way of
example, we recently litigated to prevent the use of trade secrets stolen
from our client, a specialty chemical manufacturer.
In that case, our lawyers moved quickly to prevent the possible
destruction of evidence by obtaining a court order to conduct expedited
discovery. Then, using the
information gained through discovery, we were able to secure a preliminary
injunction against the further use of the trade secrets.
At trial, the court permanently enjoined the defendants and awarded
our client its actual and punitive damages.
Our objective in all cases is to provide valuable advice and
aggressive representation at a fair price.
Shareholder/Partnership Disputes.
Our
lawyers regularly represent shareholders and other business partners in
disputes concerning issues of corporate governance. We routinely advise shareholders in closely held corporations
concerning their rights to participation in corporate management.
Our firm has litigated to protect the interests of minority
shareholders who are being oppressed by majority shareholders and to
preserve our clients’ rights during the dissolution process.
Construction
Law.
Our firm handles a substantial volume of construction-related legal
work, representing owners, general contractors and sub-contractors.
Our practice includes representation in a variety of forums,
including mediation, arbitration and litigation.
In addition, we routinely file, enforce and defend lien claims on
behalf of our clients. Representative
clients include M.J. Anderson Construction Corp., Torrey Homes, and The
Cunnane Group, Inc. Our
practice also includes the defense of sureties.
Employment
Law.
We regularly advise our clients
concerning a wide range of employment-related issues.
For example, we have substantial experience in drafting employment
agreements, non-competition and confidentiality agreements and employee
handbooks. We also advise clients concerning compliance with state and
federal statutes, including anti-discrimination provisions of the United
States Code. Our litigators
regularly represent both employers and employees in disputes, both in
court and at arbitration.
